Buildings with Torsional Irregularity

I am analyzing a 2 stories building according to ASCE 41-17 and nonlinear static analysis. It is a Category I building. Using the Immediate Occupancy (1-B) and the 5% @ 50 years spectrum all elements of the building check OK for rotational, shear and displacement. The building is OK according to the nonlinear results. I have a discussion with a colleague because he defends the anyway we have to check the building to see if it comply with the following regulation included in 7.3.1.2.3 (Limitations for the linear analysis). It is my understanding that we don't have to check it because all elements are OK after the nonlinear analysis.

Section 7.3.1.2 describes the limitation in the use of the LSP and it is irrelevant to the nonlinear types of analysis NSP and NDP.
Even if there were failures in the nonlinear checks, you would not have to check 7.3.1.2. On the contrary however, one has to consider the limitations in the use of the NSP in section 7.3.2.1
