Yes, at the first step of the incremental (pushover) analysis no incremental loading is applied yet, and the qequilibrated state reflects the initial (i.e. gravity) loading

The takeda curve was initially developed for the hystereitc curve of R/C elements. It is mainly up to you and your supervisor to decide if the curve is suitable for the structural configuration of your steel model.

The only limitation is that it has to be used for academic and not commercial purposes, and that it is referenced appropriately.
There is no time or usage limitation, though.
